NGA Law quoted in The I Paper – ‘people need to realise the lengths we’ll go to’

The I Paper has featured a story about British parents Amita and Sham whose twin boys Rey and Ryo were born through surrogacy in Ukraine in July this year. As the headline says, the story reflects the lengths intended parents will go to to have a desperately-wanted child, even travelling to a warzone for surrogacy if they feel there are no other viable options.

As the law firm which helped the full group of British parents expecting babies through surrogacy in Ukraine when the war broke out in February 2022, we know how popular Ukraine surrogacy used to be. As quoted in the I Paper, “Before Russia’s full-scale invasion in February 2022, Ukraine was the third-most popular for British couples after the US and UK, according to fertility law firm NGA Law.”.

The Foreign Office currently advises against entering into surrogacy arrangements in Ukraine, and the numbers of British parents doing so has fallen dramatically over the past two years. However, while UK law remains stuck in the 1980s and does not properly support surrogacy at home, parents who need the help of a surrogate to conceive a child often feel they have no choice but to look overseas. And while the majority go to the US where surrogacy is safe, ethical and well regulated, those who cannot afford to do so look elsewhere, and Ukraine remains one of the few countries where the law supports surrogacy and recognises them as their child’s legal parents. This family’s heartfelt story demonstrates the urgent need for UK surrogacy law reform to improve the accessibility of surrogacy in the UK.
